| 《Copyright Law of the People’s Republic of China》 has been amended many times since its promulgation, while the practice of "current news is not regulated by copyright law "has never been changed. To the connotation and extension of current news, scholars from journalism and the science of law both have their different conclusion and a united definition has never been reached. This paper attempts to restore the "current news "and that the original meaning of "current events work", and thus propose amendments to the"current news "and copyright protection as the foundation, hope to improve on the Copyright Law helpful.Besides the introduction, the main body of the thesis is composed of the five parts below.Chapter One:To investigate the Situation of China’s current news copyright protection legislation and existing problems. From the Situation of China’s current news copyright protection legislation, judicial practice paper expounds the presence of current events do not meet the definition of the practice of journalism, there is a contradiction between the relevant provisions of current events copyright protection and other issues.Chapter Two:Redefining the concept on the current news. Look at the science of law and scholars from journalism.Chapter Three:To investigate further the definition of "current news" and should be subject to copyright protection.Chapter Four:Discuss current events relevant laws and regulations of foreign Experience. Our country can learn from foreign experience places.Chapter Five:Explore the "current news "and the legal protection of copyright terms revisions. Proposed the "abandonment model" and "improvement model" two opinions, and compared with the choice. |
