| There is no a unified point of view about the protection of the current news. Because of that the current news is excluded from the range of the Copyright Law, the number of the copyright infringement charges is increased and a large of problems were brought in juridical practices. In a word, it is bad for the stabilization of the News Marketing.In order to fundamentally solve the problem of current news infringement disputes, this paper uses the hermeneutic method, method of comparative analysis, empirical research method and historical analysis method to explore the connotation of the current news, to recital the international legislation, to find out the advantages which can be used for the current news copyright protection system in our country. This article will discuss the legislation protection of the current news from four parts: the first part shows the problems existing in the current news legislation protection from a case; the second part reshapes the definition of the current news by comparing the current news, the news work and the topicality articles; the third part shows the reasons for the copyright protection through the ingenuity, the expression forms diversity, the relationship between the current news and the public right; the forth part puts forward the suggestions of perfecting our country’s current legal protection.Finally, the paper redefines the current news to be the report refers to the recently domestic and international political, economic, social events by newspapers, radio stations, televisions and other news organizations. At the same time, the point is raised that the copyright law does not protect the simple fact news, rather than the current news artificially limited. The new definition of the current news, the classification protection of the news work, intelligent and the timeliness protection of the current news are raised to protect the current news. |
