Study On China Higher Education Legal System Since The Reform And Opening-up

Since the reform and opening up, with the development of democracy - legal system and the improvement of reform in higher education, China higher education law has achieved historical development through primary foundation to fast development then increasing improvement, promoting the development of higher education in our country. However, due to many factors, our higher education legal system compared with that of developed country and the development of higher education, has many problems and so to some degree limits higher education's development. In my view, we should study further our higher education legal system, Conclude successful experience and problems during the more than thirty years construction and put forward a policy for perfection after drawing on advanced experience from other countries. It is of great significance to strengthen legal construction of higher education and ensure our higher education and fast development.This paper is divided into five parts, making a systematic study on China higher education law since the reform and opening. In the first part, from the legal system and the concept of legal education, the author comes up with and analyzes the concept and connotation of higher education system. In the second part, the paper reviews the process of Chinese higher education system's development and summarizes achievements. The third part analyses the current problems existing in the system of higher education including the legislation and enforcement, judicial, law-abiding, supervision, etc, and discusses the reasons simply. The fourth part introduces higher education legal system construction in the United States, France, Japan, for example, and analyses the characteristics and the common experience. The fifth part puts forward the legal countermeasures of higher education based on foreign advanced experience.This paper mainly adopts comparative study and historical research using the law philosophy, history, law, comparative law, sociology of law and empirical knowledge. Through the introduction of development process and achievements in higher education system since the reform and opening-up, the analysis of the existing problems, the comparative study of higher education legal system's construction, and absorbing foreign experience, put forward the improving measures for the construction of legal system of higher education in China.
