At present,the transformation and upgrading of the economic structure has brought about the complexity and instability of labor relations,which has led to frequent conflicts between labor and capital and even mass incidents of labor and capital.In the face of the current labor relations situation,as the spokesperson for employees' rights and interests,the trade union is facing unprecedented challenges.How to play the basic function of safeguarding rights is more important than ever.As the downtown area of Zhaoqing city,Duanzhou District has been accelerating its integration into the Guangdong-Hong Kong-Macao Greater Bay Area in recent years.It has experienced the development of traditional industries such as "closed,closed,stopped",and the establishment of new industries.Labor disputes are more frequent,which restrict the local economy and social development,the pressure of defending the rights of Duanzhou unions cannot be ignored.The unpaid-salary claim of K shoe factory in Duanzhou is taken as a local case.Through details of analysis,we can reflect the various problems that the union has in the process of rights protection negotiation and labor control : the conflict of responsibilities as a "dual agent",the low efficiency of rights protection,the poor mobilization and integration capacity,the lack of transmission structure with the nation,and the difficulties of organization support,resource acquisition and leader election under the context of nation.Based on the analysis framework of Corporatism,the article analyzes the failure of the unions in Duanzhou in protecting the rights of employees from the aspects of the responsibilities conflict of the trade unions in "protection of rights" and "stability maintenance",self-construction,organization system,trade union-state transmission structure,and national standard.For further improvement considerations of effectively exerting the role of labor rights protection by trade unions,this article introduces the advanced practice of domestic trade unions in performing the function of safeguarding rights.With the help of the “socialized rights protection” in Yiwu city and the source governance experience in Shenzhen,it provides a reference for the improvement of the protection of trade unions in Duanzhou District.In view ofthe specific difficulties faced by the labor union in Duanzhou District,five countermeasures are put forward: the logic of improving the relationship between the union and all parties;introducing the socialized strategies for the protection of labor rights by the labor unions the construction of the trade unions organization system;setting up the transmission of labor union's rights and the "borrowing power" system,improvement of legal support,and reconstructing the two-way flow of dialogue between the labor union and the government.
