The Trade Union's Role Conflict In The Process Of Safeguard Legal Rights

China trade union since the establishment of a market economy has gradually become normal and developed extremely rapidly. Its role, as represent and safeguard the legitimate rights and interests of laborers fundamental role, but also more and more has been recognized in law and by the community.However, due to the special development of China trade union, in a very long period of time Trade union danced of the stage role in the community active as a "Party Work Department", "Chief three sections". This is far from the requirements of the Marxist theory of trade unions, and the requirements of the socialism's development, and the requirements of trade union's own development. The problem about the role of trade unions in practice has not fully resolved, even has a great conflict with its role recognized. This conflict of roles resulted in adverse of the protection function of trade union, and sharpening the conflict between employer and employee, and burying hidden trouble to social stability, which is not conducive to stable labor relations in China, to establish the overall goal of harmonious society. So resolving the conflict of trade union is very necessary to coordinate the labor relation and to accelerate the stabilization of society.The author believes that the reason of the trade union's role conflict in the process of safeguard legal rights is that the role is variety and interlaced, and the status of trade union isn't regarded, and the enforcement of trade union rights isn't enough. So the way to resolve the conflict is to make the trade union's role in the process of safeguard legal rights single and unmixed. In this article, the author mainly explain the theory of trade union and its role, then explain the situation,the effect,the reason of trade union role's conflict.
