Empirical Analysis And Formulating: Study On The After-Legislation Evaluation

Recent years, the After-Legislation Evaluation has become the important method of enhancing legislation quality and constructing the harmonious socialism legal framework. Along with the practical exploration and summary of experience across the local government, the after-legislation evaluation is on the way of normalization, institutionalization and legalization. The aim of the study is to make a summary of experience on after-legislation evaluation practice in theory, and to probe the theoretically support, from the point of regional regulation; then to give our suggestion on the formulating of the after-legislation evaluation.The After-Legislation Evaluation is one part of the Legislation Evaluation, as a kind of after-evaluation and supervision to the legislation quality. But it different from the inspection of law enforcement and Record-checking System, it is a independent system to evaluate and supervise the legislation quality. Now many scholar has been studying and stating on the After-Legislation Evaluation, but has no deep discussing on the philosophical basis of it. It is a trend to institutionalize the After-Legislation Evaluation, but it need the support of the philosophical basis. We give a rammer on the philosophical basis, includes the theory on Democratic Legislation, the theory on Efficacy of Law,the theory on the Policy Evaluation and Cost-effectiveness. On the basis, we select three practical examples, AnHui Province, HeBei Province and Hangzhou City, to make empirical analysis, and give our suggestion on the institutionalization of the after-legislation evaluation.
