Where there is organization, there is evaluation. It is the evaluation which decides the behavior of organization. Conducting evaluation is the basic means of organization management and support condition of achieving organization’s goals. The establishment of a result-oriented, scientific, and realizable evaluation system in local government and party is significant for the image of central government. In order to strengthen and enhance the leadership of the party, promote the modernization of national governance, advance the rule of law, and improve the efficiency of governance, it’s essential to build a result-oriented, scientific and reasonable, feasible evaluation system for the local party and government. Government evaluation framework generally covers the theory system, organization system, technical system, laws and regulations system, the system mechanism and intelligent systems. This top-down evaluation framework is in service of the implementing of local party and government’s core work. In essential, it is an objective assessment, which assumes that the goal itself is correct, and pursuits the efficiency of organization and management. It is believed that the achievements of 30 years of reform and opening up are remarkable and inseparable, which is related to the evaluation system. But with the advancing of the socialist market economy system, the external environment of the party and government management has changed, as well as the goals, tasks and the way of implementation. The traditional evaluation system causes a series of problems, such as evaluation management confusion, inconstancy of policies. These outcomes are not consistent with the principle of socialism country construction and the rule of law in the new period. Under this circumstance, it is necessary to solve these problems that stem from the evaluation system based on the rule of law. This article aims to discuss basic subject of local party and government’s evaluation system, including how to deal with the right of conducting evaluation, how to build a scientific and practical indicator system, and how to regulate and optimize the evaluation, etc. This paper applies the method of normative analysis and empirical analysis, focuses on evaluation system and legal system in local party and government, discusses current issues and the legalization of evaluation and its system. The main result of this research is: first, based on the theory requirements of organization assessment system, multidisciplinary theory is used, including the theory of rule of law, the law-based government, scientific development, target management, government performance evaluation, etc.; second, based on the notion of evaluation system, the organizational system(includes evaluation supervisor, object, procedure, and results) and technical system(includes indicator system, weight of indicator and evaluation standard, the indicator system) is discussed; third, the sampling survey and in-depth interview is used to collect comments and suggestions of public servants on the current evaluation system; fourth, based on the experience at home and abroad, this paper discusses the relationship between building evaluation system in local government and promoting government performance evaluation, and the practical suggestions follow. The conclusion of this paper is: in the view of system theory, aiming at the existing problem of reality, a scientific, reasonable and perfect evaluation system should be established in local government, and then make it legalized. In fact, the legalization of evaluation system ensures that the evaluation system is comprehensive and normative, functional, stable and impartial. Thus, the evaluation system in local government should base on objective assessment, but not be limited to the objective assessment, and aims at performance orientation of objective assessment, in order to make the goals and decisions more scientific, democratic and legalized. The innovation of this paper are as follow. First, based on the perspective of system, the evaluation system, including the concept of system, the theory and method system, content system, etc., is established. Second, derived from the empirical research, the methodology to analyze the problem is provides. Third, we suggest that government performance evaluation should lead all of other evaluations, unify the right of organizing, ensure the diversification of the right of implementing, unify technical framework and unify the application of results.
