A Study On Special Compensation P & I Clause

International Convention on Salvage 1989 introduces the special compensation, but the article itself has some uncertain parts, affecting the assessment of remuneration and special compensation. SCOPIC——Special Compensation P& I Club terms, redefined the relationship between the traditional remuneration and the SCOPIC remuneration.SCOPIC terms take the spirit of International Convention on Salvage 1989, adhereing to the traditional principal of "no results, no pay", and provide new system. In addition to the main clauses, SCOPIC regime including Appendix A, Appendix B, Appendix C, as well as Code of Practice between the ISU and the International Group of P&I Clubs, Code of Practice between International Group of P&I Clubs and London Property Underwriters Regarding the Payment of the Fees and Expenses of the SCR under SCOPIC, Salvage Guarantee Form ISU 5,Guidelines for Shipowner's Casualty Representatives. In the new regime, salvors, ship owners, P&I, cargo owners, insurers can keep abreast of new information, and payment calculation becomes time-saving and easy. SCOPIC terms give the solutions to the most of the troubles caused by Article XIV of Salvage Convention. New regime is more practical and feasible. If the terms was adopted in a salvage operations, interested party should be authorized different rights and suffered different obligation from the convention.Since SCOPIC terms came into used in 1999, they have been amended several times. There are 1999,2000,2005,2006 four different versions, and the latest one is SCOPIC 2007. Amending the terms is to solve practical problems, and now there are further discussions in the field to develop a new system.In China, SCOPIC terms are already used in actual cases, but there is no relevant system, which become the obstacles to effective application. However, due to the Maritime Law of China follows the International Convention on Salvage 1989, the problems caused by Article XIV, also exist in our country. SCOPIC system is worth learning and considering in China.
