Before reform and opening up, the population mobility in China from rural areas to cities is severely restricted by binary structure. The formation of binary structure limits peasants to the countryside and agriculture; therefore peasants are deprived of the opportunity of flowing to cities freely. After reform and opening up, with the policy restricting rural labor force transfer becoming loose, a large number of the rural youth hoping to change their economic and social status streamed in cities to seek advancement, thus forming the enormous social group of the peasant worker. The phenomenon of peasant worker is inevitable under the interaction of the economic development and social system in our country. The group of peasant workers, as the result of China's reform and opening up, is another vulnerable group. Although they are defined as peasants under the current household registration system, peasant workers have long been separated themselves from peasants and melted into urban society to some degree and no longer engaged in farm production. Due to the difference between town and countryside resulting from history and system, the gap between peasants and urban inhabitants is striking. Compared with these two groups, peasants who come into cities to seek for jobs form a relatively large"intermediate class". The binary system which our country has been employing draws a line between the rights of peasants and those of urban inhabitants so as to cause the non-equivalences of their rights and obligations. The profession of peasants is deeply marked with identity. Peasants, who stand for lower rights and lower social status, enter the cities and are engaged in non-agricultural jobs, but they are not treated as real workers, and suffer all kinds of discrimination, they can not enjoy the equal rights as urban inhabitants. The cases that their right to survive and develop is violated are not uncommon. This article discusses the four respects such as their right to vote, their right to employment, their children's right to education and their right to social security which peasant workers face, analyses the causes that these rights are not guaranteed and further comes up with some suggestions.The group of peasant workers is a vulnerable one and the issue as to protect their rights is arousing wide concern from all walks of life, including the Premier. This issue is also the focus of scholars'concern and many socialists, economists and jurists, from different angles, have been doing research into the issue about protecting peasant workers'rights and have brought forward some opinions worth learning.To protect peasant workers'rights is an incumbent obligation of our country as well as a sign of democracy. That peasant workers'right is not effectively guaranteed will not only affect the survival and development of their family members but also go against social stability and economic development, so the government should pay attention to the existence of these problems, attach importance to the issue of protecting peasant workers'right and take effective measures. We hope that the system for protecting peasant workers'rights could be further promoted and our society will become more harmonious and beautiful.
