A Comparison Of The Food Safety Legal System Between China And Foreign Countries

Food safety related to all mankind life and health and safety, related to social harmony and national stability. A series of food safety incidents, such as outbreak of mad cow disease in 1996 and famous domestic Sanlu "melamine" in 2008, make food safety threat become one of the main public health threats. Especially after China's accession to WTO, foreign trade in the green barriers for China's food export trade is increasingly obvious. In this case, it is very important to strengthen and improve the legal system of food safety.In China, there are a series of laws and regulations, that is "Food Safety Law of the People's Republic of China" issued on February 28,2009, "Communicable Disease Prevention Act", "Product Quality Law" and " Protection Act of the Interests of Consumers" etc., which constituted the legal system of food safety. However, there are many defects, such as the lack of unity and coordination, more supervision authorities and responsibilities unclear, and many other issues.China's current legal system related to food safety has many flaws, that is, the lack of unity and coordination, more supervision authorities and responsibilities unclear, and many other issues, which has been unable to meet the needs of the development of modern society. To some extent, there is a gap in research on food safety legal system between China and developed countries. It is significant to study the research on food safety legal system, which is in favor of improving the food safety supervisions, developing the healthy food industry, promoting the efficiency of the regulatory regime and maintaining social stability.Through the comparison of the food safety legal system between China and foreign countries, this thesis analyzed the current situation of laws and regulations on food safety and the existing problems in China. On the basis of advanced research of foreign countries and combined with China's present circumstances, this thesis has a preliminary study on the concept of food safety, food safety situation in China, the defects and improvement on the legal system of food safety and put forward the feasible proposal on improving the food safety legal system in China.
