The continuous fermentation and ever-growing number of food safety problems have raised the attention of many experts and scholars.People also have constant and strict requirements on food safety.Food functions as the most basic substance for human survival.As a common food,soybeans also have serious security problems.As soy and original countries of soybeans,as once the world's largest net export country,China is now gradually losing soybean pricing power in the world,and even evolving into soybean import country.Soybeans in many other countries have posed serious threat to soybean industry in China.It is researched that the soybean standard system construction is the important basis of safeguarding soybean food safety.Based on this,the paper,from two aspects,studies the China's soybean standard formulation and implementation and puts forward the perfect measures.Specifically,this paper mainly has four parts,that is:The first part is the basic theory of the legal system of soybean food safety standard.Currently,food safety standard is the basis of the administrative department of law enforcement.It is often used as the basis for judgment in the court.Because of its particularity,soybeans plays the double effect in public law and private law,which reflected in its mandatory national standards.Based on national conditions and a variety of reasons,the current problem of soybean food safety standards,requires more research to perfect the legal system of soybean food safety standards.The second part is the problem of the legal system of soybean food safety standard in China.Soybean in China has many problems,that is : uncompleted,repeated,disconnected in processing,deficiencies in risk analysis for technology,uncompleted consultation by reason of experts selection and interest,lack of the public participation,not strict implementation of the regulation of food safety law on penalties,insufficient encourage to develop enterprise standards,incomplete supporting measures,insufficient supervision mechanism,imperfect supervision team in lack of talent cultivation.The third part is the experience and reference from overseas soybean food safety standard system.Mainly,it is aimed at the summary of the United States,the European Union and Japan.The core part is the improvement of the standard system,supervision system in the whole process from farmland to dining table,coordinate regulatory arrangements.Based on this,our country should pay attention to the foreign standard experience and learn from them.The fourth part is the consummation countermeasure of Chinese soybean food safety standard.It is suggested to avoid uncompleted,repeated,disconnected in processing,deficiencies in risk analysis for technology,uncompleted consultation by reason of experts selection and interest,lack of the public participation.It is standardized to strengthen the penalties and to perfect the implementation of the law.It is reasonable to encourage and support enterprises to improve the supporting measures.It is wise to attach great importance to the concept of social forces and to perfect the supervision mechanism.Governments should pay attention to the cultivation of compound talents to improve the supervision team.
