The executive power is the core of the power of a nation, the present situation of the administrative enforcement of law shows that there are various defects and some deadly serious problems. Though administrative proceedings entitles the folks some rights of suing the officials, whereas the administrative power by itself is of being great power, easily swelled, self-judged and hysteresis, contracted pelvis, but to most of the folks, administrative proceedings can not guarantee their rights. with holding the ideal that rights lead to corruption, and absolute rights lead to absolute corruption and without absolute supervision and effective supervision of administrative power, the officials who possess some administrative rights can not balance relations and laws so that some cases appear in the court; also the officials can not resist the temptation and conduct the laws at random and take the bribe, at the worst they will commit the crime by taking advantage of their posts. Therefore, we need a more reasonable, effective supervision on administrative power. Some scholars hold that the essence of laws is to restrict and supervise the administrations of the nation and servants. The 129th item of our constitution is:people's procuratorate is the supervision administration of national laws. In the aspects of theories and the position of the laws, procuratorial organs enjoy the rights of supervising the conduct and the conduct of abiding by the rules. This thesis through the research on the history of supervision system in administration from the perspective of constitutionalism mentioned the managerial features of the supervision on administrative power; through the study of the present situation of supervision on administrative power the writer tried to find the defects inherent and perfect the administrative supervision, which will be enhancing the development of the supervision functions of procuratorial organs.
