The Research On China's Food Safety Law

Food security is not only an important part of state security but also the basic material foundation of developing the national economy and constructing the harmonious society. In order to safeguard food security, China shall adopt and improve various protective methods and measures including technology, economy, administration, law and so on. Therefore, in view of the flaws in the domestic law protection of food security,However, from the present situation, even though China has a comprehensive agricultural code-Agricultural Law, but the bill only provides for a series of issues of principle, without specific protections for our country's food security in specific practices, and no detailed requirements. At the same time, China's food safety laws scattered in the other codes which are difficulty to operate, and many of them haven't been amended for a long time to meet the requirements of the present stage. Therefore, this article will discuss China's food safety laws, and comparing with food security of foreign legal systems in developed countries, it will make my own modest proposal on the establishment and promotion of China's food safety laws.The basic ideas and logical structure is as follows:The first chapter introduces the concept of food, pointing out that the basic properties of food, which is both public and private. It also introduces the concept of food security, my own food security concept is proposed as:China's food security refers to safe food meeting our own needs of human survival and development of health and nutrition in any case on the base of the lowest possible cost. It also focuses on the importance of food security in China;The second chapter describes China's current food security situation, elaborating on the internal problems and foreign aggression. At the same time, from the basic properties of food, it discusses why there should be legal protection for food safety and food security and legal basis for legal protection.The third chapter focuses on food security system in the developed countries as the United States, the European Union and Japan. With China's national conditions, from the protection of arable land, promotion of farmers'enthusiasm to grow grain, the protection of national strategic reserve of grain, it discussed how to improve the legal system comparing to the three aspects;and the anther opointes out other legal system on food security should be improved. In this paper, it discusses how to perfect China's legal food system from the aspects of the early warning legal system, grain circulation legal system, the legal system of food science and technology and food quality and safety.The main contributions of the paper are:1.from the protection of national sovereignty and security it discusses the importance of the protection of national food, and it points out the legitimacy and necessity of legal protection for food security; 2. Through the analysis it sorted China's laws on food security and proposals on the development of these legal systems are provided.
