The Study Of The Party's Petition System

Petition system is a democratic political system, formulated and implemented by the party and state organs , in accordance with legal principles and procedures ,to protect the people's legitimate rights and interests of petitions ,to achieve the management functions of the petition activity. The party's petition system is the important channel and bridge for the party and country to close with the masses and the hub, is a constituent for the people to directly involve in the political system, an integral component of the socialist democratic system. The party's petition system has played an important role in maintaining social stability, providing the right to relief for the masses.Petition activity has a long history, but the modern petition system was established after the new China's foundation. Before November 1950, Petition activities was part of the secretary works of the party and government organs at all levels in China. Petition system was at the dependent stage of development. After November 1950, the petition system was gradually established as a stand-alone system ,and was in the independent stage of development. With the development of the times, the Party's petition system is rendering the main features of the system constructions in different periods.In the sixty years after the New China was founded , the Party's petition system has made new achievements. However, with the continuous deepening of reform and opening up and the Continuous differentiation of the various social interest groups,lots of problems arising from the reform was collected amoutly together to the petition departments.The Party's petition system has turned up some flaws under the overwhelmed situation and triggered a series of outstanding petition issues at the same time. The petition institutions are heterogeneous and in lack of overall systemic heterogeneous.The petition system are in inaccurate function location,and has assumed too much social responsibility.These flaws result in the lowly work performance of the petition system, the lag of petition workers project ,and make the petition work not carry out efficient.The institution which a petition project is drawn to a close through three levels of the state organs has a contradiction between theory and the reality.The petition departments are not explicit in its power and duty.The petition legals are not perfection.These flaws lead to a series of problems such as the high petition volume,the multiplication of the non–systematize petition activities and the petition issues relative to the legal, then the petition works' healthy develop and the social stability was influenced severely.The Party's the seventeenth convention report put forward a requirement—"improve the petition system",which has marked the new era of the petition system construction.Improving the Party's petition system is to adjust the petition service process reasonablely in accordance with the law, is to incorporate a series of petition working style,controling device,operation steps,operating process and management system into legislative track, is to form all sections of the petition system's formulation,performance,supervision and maintenance into a rigorous system,is to bring the petition system itself into play preferably in service for the masses. To improve the party's petition system,we should take the mass line and viewpoint of the masses as the ideological foundation,and take the good governance as the party's petition system improvement goals. The Commissioner of the NPC's supervisory system should be established on the base of the National People's congress system, so that the deputy to the people's congress could take the specialization and professional supervision to the party and government organs at all levels;The petition Public Counsel System should be established ,so that solicitors could provid daily legal services for the masses; Non-governmental social organizations should be cultivated in participating the petition work, so that the contradictions could be resolved at the grassroots level and in the bud; Psychological counseling service should be enhanced in work of the reception of petition visitors,so that the masses could be guided to participate the political system orderly ,and the petition work could be improved efficiently; Relief fund system should be established,so that people's basic rights could be safeguarded through two different channels of judiciary and petition; But,the process of rule of law in petition system should be speeded up,as the nationwide complete petition legal system is the fundamental way to improve the petition system.
