With the development of the real estate market, Real Estate Brokerage becomes a separate industry.In the promotion of the real estate market boom ,at the same time, there are many problems in the industry itself. As part of a special intermediary ,real estate brokerage industry does not require large investments and mainly provide services,within non-possession of goods and bearing the risk. Resulting in volume expansion of small, low quality of the entire industry , real estate brokerage institutions have establish conditions for the low, coupled with a lack of supervision.There have been cases occurred such as Beijing Jian Shi, Tianjin Huizhong and a series of cases of the most influential real estate agencies, making real estate brokerage industry into a corner. How to solve the difficulties faced by real estate brokerage industry is becoming more and more urgent. This study focused on the real estate brokerage agency supervision, and how to make an effective monitoring system has become a matter of urgency and is the subject of thesis writing process.This paper is divided into four main parts:The first part of the issues comes from a specific case - "Shenzhen Zhongtian case" proceeding raising regulatory problems in the real estate brokerage.The second part is the answer of what real estate brokeage is. It defines the concept of real estate brokerage and clears the nature of real estate brokerage using qualitative research methods. Then it introduces the organization form and business model of real estate brokerage. Finally it describes the causes of the real estate brokers and their important role.The third part analyses the China's real estate brokerage organizations and their regulatory status of using the application of empirical methods and explaines the causes of regulatory issues of real estate brokerage industry. According to the author`s master of the literature, many papers on the study of the status of the real estate brokerage industry are remain in the vague description of the phenomenon and lack of data to support and in-depth analysis.This paper demonstrates China's real estate agencies and access to low threshold current situation, supporting by Beijing, Shanghai, Shenzhen, Chongqing`s authority of the statistical data. The part sums up the real estate brokers conduct of operations from a large number of literature and consumer complaints.It is not standardized, mainly reflecting in the fees unreasonable, the lack of transaction monitoring funds, and industry dishonesty. From the legislative status of the regulatory laws and regulations, such as "The People's Republic of China Urban Real Estate Administration Law", "Urban Real Estate Intermediary Service Management states" ,there is no specific regulation of real estate brokerage law and regulatory law rank is low.The law provides for the principle more and operability is not strong.There are also some conflicts between the laws and regulations.The fourth part of the article is on how to solve China's real estate brokerage to oversee the problems in policy recommendations in detail mainly from the supervision of the main body , regulation in advance, a matter of regulation and post-regulation.There are three suggestions including a clear accountability of the government of regulatory functions, speeding up construction of the real estate brokerage industry associations,and a actively play of the role of third-party supervision. Secondly, we must improve the legal system of supervision of the real estate brokerage, the access threshold of real estate agencies, and the strict qualification system real estate agents. Finally, we must implement the annual inspection system for real estate agencies ,speed up the credit record system of the construction industry, and increase penalties for violations.
