Three-Dimensional Structure Of Criminal Policy And Juvenile Criminal Policy

The society and the theorists pay much attention on the juvenile problem. The research on it developed very well. This article intents to establish the basic structure of criminal policy. That means to realize the establishment of a stereoscopic pattern on criminal policy by the establishment of longitudinal dimension and horizontal dimension. And realizes the comparative analysis between the adult criminal policy and juvenile criminal policy in such pattern. Then expounds macro concept of juvenile criminal policy finally.This article is composed of three parts. The first is the summary of criminal policy. It reviews the theory about the classification of criminal policy when traces back the source and development of criminal policy. It chooses the dichotomy to divide the criminal policy after comparing with the past classification. It means to classify the criminal policy by the effect of different domains, that is the broad criminal policy and the narrow one. And it searches the support from theory for the juvenile policy during the development of criminal law. Then establishes the basic structure of criminal policy.The second part inherits the analysis to the dichotomy on the longitudinal dimension, in which it integrates the axis of horizontal dimension on the ground of longitudinal dimension, to realize the systematic analysis to the criminal policy. Then the basic structure of criminal policy established. It can be divided into adult criminal policy and juvenile criminal policy in the horizontal dimension. And in the longitudinal dimension it divided into the broad criminal policy and the narrow one. The broad shows the full view of criminal policy domains. The narrow expresses key point of the juvenile justice work, juvenile delinquency and juvenile. Then this article discusses the practical function of horizontal dimension from comparing the individual differences between juvenile and adult. And explore the practical foundation of juvenile criminal policy from the cause of juvenile delinquency.The third part talks about the longitudinal dimension. It discusses the object, the target, the subject, the method and the carrier of juvenile criminal policy, and gets the concept of it eventually. Juvenile criminal policy means a system which is organized by the country and society and put into practice to the deviant youth to prevent and control the juvenile delinquency.
