An Empirical Study On The Legal Quality Of Party And Government Leading Cadres

Legal quality is a rich connotation of the concept. It refers to the general quality of a person's legal knowledge, legal awareness and legal acts through a certain learning and social practice. The legal quality of leading cadres is the mental structure received from the leading activities of practice and legal education, it was a process of internalization of the physical, and was an important quality of leading cadres'political components. To improve the leading cadres'legal quality has great significance on the strategy for the implementation of the rule of law, developing socialist market economy, carrying out the leading cadres of social responsibility and historic mission, and improve the legal quality of the whole people. Sampling from a coastal province, we developed a scale to measure the quality of leading cadres. The current status of legal quality of party and government leading cadres was revealed through empirical method. The restricted factor was made an in-depth analysis, and the suggestions to improve the quality of leading cadres of legal countermeasures were put forward. This study suggested that the rule of law was the lack of traditional constraints of China's party and government leading cadres in the law to improve the quality of important historical reasons, imperfect democracy and legal environment that hinders the improvement of the legal quality of leading cadres in important external causes erroneous understanding, restricting the legal quality of leading cadres in important to improve the underlying causes, methods and content of legal education is the irrational legal constraints leading cadres to improve the quality of the direct cause. At present the legal quality of party and government leading cadres still far from the rule of law and building a socialist country ruled by law requirements of the times, we should actively look to improve the quality of leading cadres in the law effective way. Firstly, is to shape the legal and cultural development of leading cadres'law of faith, secondly, is to establish the legal basis to establish the power of checks and balances. Thirdly, is to improve the quality of the legal system to provide effective protection, fourthly, is to increase the leading cadres of legal education the intensity. Fifthly, is to use the legal quality of the party and government leaders as a necessary condition for selecting and appointing cadres. Lastly, is to strengthen the judicial reform and legal system construction environment for optimizing the rule of law.
