| Letters and Calls system is a system with chinese characteristics in the socialist construction of China. Its formation and development has deep historical and realistic foundation. It serves as an important way for citizens to exercise theire democratic rights, safeguard their legitimate rights and interests, participate in policitcs and express their intersts and demands; it serves as an important channel for the government to promote socialist democracy, listen to the advices and demands of the masses; it is also a great reflection and achievement of the construticon of socialist democracy and rule of law.However, with the deepening of reform and open-up and the social transformation, there are a number of problems with the Letters and Calls sytem which used to play a positive role in history. The booming number of Letters and Calls cases brings more and more "Letters and Calls peaks". The government amended the Regulations on Letters and Visits enacted in 1995 and implemented the new Regulations on Letters and Visits on May 1st,2005. The new regulations played a role in mitigating the intense situation, but it still can't solve the problem fundementally. The number of Letters and Calls cases was still large, and only 2%o problems could be solved. The Letters and Calls agencies bore great pressure and carried a lot of undue responsibilitie. The unpromising situation was hamful to socila stability, affected the close relations between the Party and the people, lowered people's trust in the Party, decstroyed the independence and authority of judicature and acted inimical to the construction of country under rule of law and hamounious society. It is impossible to solve the problems by only amending the Regulations on Letters and Visits considering the severe situations of Letters and Calls. Scholars and practitioners put forward kinds of reform suggestions from theoretical and practical aspects:to cancel it, to strengthen it or to weaken it. The author believes that the reform on the Letters and Calls system should be lonng-term and systematic rather than reaching the goal in one step.There are five parts in the thesis. The first part is about the significance of topic, the findings by the predecessors and the innovation by the author. The second part is about the concept and development of Letters and Calls system. The third part is about the basic theory of Letters and Calls system. On the foundations of theory, constitution, traditional ideas and social reality, the thesis analyses the acutual and due functions of Letters and Calls system in China. The fourth part discusses the defects of Letters and Calls system in social trasformation period and their effects. The thesis summerizes the new charicteristics of Letters and Calls system by analysing the connotation of social tranformation period. In the fifth part, the author provides the strategies on the reform of Letters and Calls system in social transformation period:to promulgate Letters and Visits Law, to integrate Letters and Calls agencies, to set up auxiliary systems and to accelerate the judicial independence. The aim is to find the proper position of Letters and Calls system, to drive it into the normal track of rule of law and to further promote the social harmony and stability. |
