Tourism has become one of the world's most rapid development momentum in the world, and plays an more important role in economy。Especially since 90s the 20th century, tourism has achieved rapid development and become one of the world's largest industries. Tourism is a strategic industry, with low resource consumption, large coefficient, better employment opportunities and better comprehensive benefits. Since the reform and opening up, tourism has become an important part in Chinese life, China's tourism industry scale has been expanding rapidly, the systems are maturing. Industry can not develop without the protection of the law and norms, our country's tourism laws and legal system has taken shape, but compared to the trend of rapid development of the tourism industry, China's law in the tourism industry in particular has faced dilemma and serious lag.After 30 years of reform and opening up, along with Zhuhai economic growth, the local tourism legislation has improved and achieved rapid development. The formation of "Zhuhai Tourism Bill," and a series of distinct local tourism regulations have pushed Zhuhai tourism to a dynamic fast developing new industries. It also has played a positive role in optimizing economic structure and increasing employment. Zhuhai tourism development requires local travel legislative framework, guidance and protection, consummating the tourism law is an objective need for promoting tourism in Zhuhai, as well as providing the experience of the development for a unified China's tourism basic law. This study focuses on the Zhuhai Tourism legislation, through the Zhuhai Travel legislative history and present situation analysis, we discover problems in the Zhuhai tourism legislation, and then put forward our legislative proposals.Zhuhai Tourism legal system continue to grow along with the rapid development of tourism scale. Step by step, it has experienced a gradual process of development from scratch, Zhuhai tourism legilation embryonic stage (1980-1989), the legislative awareness and early legislation to strengthen the preparatory work laid the foundation for later legislation; Initial development phase (years 1989-1999), the importance of tourism legislation is gradually strengthened, particularly from 1996 to 2000 a total 22 local laws and regulations promulgated in 5 years,it was the peak season forregulations promulgation.Zhuhai also accelerated the pace of tourism legislation with the establishment of municipal tourism administrative department and the rapid development of tourism. Zhuhai, has introduced the "Zhuhai Tourism Management Regulations", "Zhuhai" one day tour "management approach" and "Zhuhai Tourism Administration of fixed-point unit," further improved the legal construction of tourism in Zhuhai, it provides a favorable market environment, strengthens the regulatory capacity for the business activities of tourism enterprises and creates the conditions for optimizing industrial structure adjustment and standardization of development;. Zhuhai tourism is to achieve rapid development and this stage. Rapid development phase (2000-present), with continuing rapid development, tourism plays a more important part in economic and social life. And itslegal relations need substantial adjustments.In addition to local comprehensive travel regulations, provinces and cities also introduced a number of highly targeted regulations and regulatory documents, related to travel safety, the establishment of branch offices, tourist resorts, tourist commodity production, tourism, business income tax return, tourist attractions, exclusive collection of funds, the individual tourist services, special tourism projects, and other scenic spots to explanation, etc. Meanwhile, under the background of China's accession to WTO, promulgating "Administrative Licensing Law" and the rapid development of the tourism industry, many provinces and cities have started to amend the local comprehensive travel regulations, forming a modified trend. In this period, Zhuhai Municipal Government also introduced a series of policy measures to promote tourism development, while in 2008 revised the "Zhuhai Tourism Management Ordinance"There are problems in Zhuhai tourism legislation, a legislative gap, the incompletion, the use of local legislative power being not enough, those should be improved through careful investigation and study, learning from other countries and regions legislative experience.The existing problems of uneven development in Zhuhai tourism, such as diet, housing, transportation, sightseeing, entertainment, shopping, the six elements and human resources, should be guided by the tourism policy and tourism legislation. Also, because the reasons for the legislation itself, the existing legislation is obviously not enough for promoting tourism in Zhuhai. First, in the absence of the basic tourism Law, the Zhuhai Tourism legislative provisions the majority principle, less entrenched clauses, a strong guide, the specific norms less, in the implementation process, showing unbalanced emphasis, understanding degree of imbalance. Second, less tourism legislation more policy leads to a lot of limitations of legal effect. Throughout the entire amount of the legal system, it reflects the tourism industry in Zhuhai on the lack of regulation, lack of legal constraints with local characteristics. Third, travel patterns and the legislative process, legislation lags behind, leading to difficulties in actual implementation.
