The Empirical Analysis On Legislation Of Shanxi Tourism

Tourism legislation is a series of activities to enact, amend and repeal tourism rules and regulations by the legislative body in order to strengthen the management of tourism. It plays a crucial role in the development of tourism industry, for it determines the direction of a country's or a region's tourism, protects the legitimate rights and interests of each subject in tourism activities, and maintains the growth of tourism industry. With the deeply development of tourism, varies of complicated relationships are formed, as well as kinds of contradictions are increasingly conspicuous. Thus, it's highly necessary to take macro-control measures by means of laws. Therefore, the developments of tourism need to be guaranteed by perfected tourism legislationTourism legislation in our country includes the national level and the local level. On the background of the national tourism legislation relatively lags behind, local rules and regulations are produced in succession with the rise of local tourism. However, there are existed some shortages, which affects the rapid development of tourism industry.This paper is concentrated on the tourism legislation in Shanxi Province. After the preliminary analysis on development status and relevant regulations of Shanxi's tourism, through the methods of contrastive analysis and empirical analysis, combining the knowledge of economic law, the author analyzes the problems existing in tourism legislation in Shanxi Province, and puts forward the corresponding measures.The paper is divided into four parts.Part 1:background analysis. First of all, the basic situation of tourism in Shanxi Province is discussed. Secondly, the problems in the process of tourism development and new social relationships adjusted by tourism law are analyzed. Finally, there are some shortages of the national level tourism legislation, which needs to be replenished by local one. Part 2:an analysis of tourism legislation in Shanxi. Legislative branches, basic situations of legislation and legislative experiences in Shanxi province are elaborated. In addition, starting with the legislative structures of economic management laws, the basic problems involved in the Shanxi tourism legislation are explored.Part 3:the comparative analysis of tourism legislation among Shanxi and other regions. Beijing is chosen as an emphasis to be compared in this part. The aspects of legislative idea, scope, protection for tourists and operators, as well as operability etc are compared from the viewpoint of local comprehensive tourism regulations and related supporting regulations. Moreover, the differences are analyzed.Part 4:the problems, causes and solutions of Shanxi tourism legislation. The problems of Shanxi tourism legislation are expounded in this part. In addition, based on the analysis of reasons, five aspects of measures are proposed, including legislative idea, legislative content, specific provision, local government regulations, and establishing system of "legislation, alteration and abrogation of laws and regulations".
