Research On The Revision Of Trade Union Law Of The People’s Republic Of China

"Trade Union Law" since 1992 promulgation and implementation,in2001,2009 after two amendments,has not been revised since.With the gradual improvement of the socialist legal system with Chinese characteristics,some contents of the Trade Union Law have been unable to meet the development needs of The Times,and their functions in protecting workers’ rights and interests,resolving labor-capital conflicts and maintaining social stability are limited.Therefore,it is in urgent need of revision.This paper will take General Secretary Xi Jinping’s important discourse on the work of the working class and trade unions’ work as the guiding ideology,through collection,analysis,research the new era of industrial relations in the new situation,new characteristic,according to "Decision of the CPC Central Committee on Several Major Issues Concerning Upholding and Improving the System of Socialism with Chinese Characteristics and Promoting the Modernization of the Governance Capacity of the National Governance System" "civil code" and other regulatory requirements,Combined with the articles of association of Chinese trade unions(amendment),"new content,fixed" Trade Union Law",make it more scientifically standardize the aim of the Trade Union Law,the nature of the trade union and task,the basic principles of union activity,the establishment of the trade union and the organization system,trade union rights and obligations,to better highlight the union the responsibilities and obligations of the rights and interests of workers,Strengthening the legal protection of workers’ rights to join and organize trade unions.Realize better thereby"Trade Union Law" legislative tenet--safeguard our country labor union is in the status in national economy and social life,determine the right of labor union and obligation,develop labor union to be in advance social management system and the important role in the modernization of management ability.This paper is divided into three chapters.The first chapter introduces the historical evolution of the "Trade Union Law" after the founding of New China.Through the analysis of this part,we find out the positioning of the "Trade Union Law".The second chapter analysis of the current problems facing the "Trade Union Law",mainly from the connection between the "Trade Union Law" and other laws,whether the "Trade Union Law" can meet the needs of modern economic and social development,whether the content of the "Trade Union Law" can be implemented in place and other aspects.The third chapter,on the basis of the second chapter,puts forward some suggestions on the revision of the Trade Union Law.
