Research On The System Of Our Country's Functionary's Property Declaration

Our government has put focus on the policy of functionary's property declaration since the 1980s. Stipulation of income declaring for the country (and higher) magistrates> was published by the Central Committee of the Communist Party of China and state council in 1995, was published by The Central Discipline Inspection Commission and the Organization Department of the CPC Central Committee on 2001,our government started to investigate and establish the policy of functionary's property declaration. But the two "Stipulations" above are quite different with the international approbatory policy both in scope and content and a big difference appears between the actual effect and ideal target after carrying them out. The effective policy of functionary's property declaration is still not found in China. Confronting the increasing corruption problem, the public's desire is growing, to find an effective policy of functionary's property declaration. This article cataloged the situation of our country's functionary's property declaration and with a realistic view, analyzed the existing problems in the two'stipulations' above. The shortcomings appear in the local practicing of functionary's property declaration policy and the other straits which will be faced when carrying out the policy of functionary's wealth declaration in our country, and also point out the real reason which caused the failure of the effective practicing of functionary's property declaration in China is the resistance from the main part of the people who need to do property declaring. Based on this foundation, the writer proposed the measure and suggestion to perfect our nation's policy of functionary's property declaration.This article was divided into four parts. The first part is introduction, a brief introduction of the meaning, studying background, document summary and studying method of this article. In the second part, it tells the developing situation of functionary's property declaration in our country, in which, it analyzes the essentiality of practicing the policy of functionary's property declaration in our country. The third part analyzes in five aspects, why the policy of functionary's property declaration has not been carried out effectively, the most important reason is the resistance from the functionaries, secondly, are the problems which exist in the policy, thirdly, is the low position of the policy in law, fourthly, is the imperfect supervising institution, and fifth is the lack of a relative institution to form a complete set. In the fourth part, is the suggestion to perfect functionary's property declaration, and it is divided into five parts, first, different methods should be carried out together to reduce the resistance, second, perfect the content of our country's functionary's property declaration policy, third, pinpoint this policy's position in law, fourth, publish the property declaration and establish the effective supervising institution, five, fully establish the relative institution to form a complete system and then remove the troubles in execution. At the end of this article, is the summary and conclusion.
