On Improvement Of The Legal Institutions Of Public Health Emergency

As the world entered the age of peace, the military threat and other traditional factor that threaten national security has been excluded form the world stage, but the public health emergency that affected by negative consequences for medical practice,lifestyle changes and environmental degradation facing the international community challenges. In view of SARS response system in China has exposed flaws, theorists have gained a public health emergency response strategy of the boom, theory community has also set off a wave of research into public health emergency. This text with the view of improving our legal system, analyze our system deficiencies from the basic concept, also attempt to give some feasible suggestions to establish a whole set of effective legal system.This paper is divided into three parts:the first part is about the fundamental issues of public health emergency overview introduces the concept and the characteristics of public health emergency. Prove the necessity of governmental administration form the sociability of the public health emergency. The second part held to compare and analyze our shortages of legal system to deal with health emergency, and introduce foreign advanced experience for reference. The third part is about improving our public health emergency countermeasures, from the legislative concept, security systems and related supporting systems, and several other aspects, to build a system of rational, internal harmony and uniform legal system to cope with public health emergency.
