Food is not only the basic material condition for human survival and development, but also indispensable for national security and social development. Its quantity and quality are closely related to human survival and health. With the improvement of productivity due to sustainable development in science and technology, the food industry, which previously involved only agricultural cultivation and livestock raising, has gradually entered the areas of food production, processing, transportation, sales and storage.With globalization of the world economy and development of the international food trade, various kinds of food safety problems result from the rapid development of different industry and the growing expansion in the span of time and space in food production and storage. Accidents endangering human health and safety occur frequently. Issues like the effects of new technologies on food quality and the pollution of fishery products caused by environmental deterioration have become the focus of the public attention. Food safety has become one of the major sources of threat to public health. At present, although all nations attach much importance to the issue of food safety, the degree of seriousness of the food safety problem varies to a large extent due to the different levels of development in economy and science and technology in different countries.In recent years, food safety has become a major social problem. Therefore, it is necessary to study it from the legal point of view. The food safety right, which people enjoy in consumption under the legal norms, embodies the survival interests of consumers. It derives from but surpasses the interests of consumers. Considering the current state of food safety issues and borrowing the food safety-laws from developed countries, we should take measures from the following three perspectives to ensure legal protection of consumers'food safety right:the civil relief mechanism, the administrative protection mechanism, and the legal protection mechanism.Apart from introduction and conclusion, the thesis consists of four parts. The first part introduces the concepts of food safety, distinguishes them from similar ones, and presents an in-depth account of these concepts. Considering the importance of precise concepts, this part serves to prepare for the following parts of the thesis.The second part presents an introduction to the food safety laws of foreign countries like EU and US, expounds the relevant legal measures taken by US, EU and Japans, summarizes their characteristics, and finds out their advantages.The third part analyzes the current state of food safety laws in our country, sums up the laws concerning the food safety, points out the weaknesses by comparing with countries mentioned in the second part, and then gives an account for them.The fourth part, both the focus and the conclusion part of this thesis, proposes various suggestions for the improvement of food safety laws.
