With the world economic development, intellectual property is increasingly becoming the national wealth and economic prosperity. Whether a country has a sustainable competitive edge, it often depends on the development of the country's intellectual property status and the degree of protection. Therefore, the 17 party congress report clearly decide to implement intellectual property strategy. However, while it is recognizing the importance of intellectual property , another problem appears, namely,which determines the value of intellectual property and how to evaluate the value of intellectual property rights.To promote the effective application of achievements of intellectual property rights, to promote the industrialization of intellectual property rights, and implement intellectual property strategy, evaluation of intellectual property rights must be addressed as theory and practice of community sector problems.In fact, intellectual property valuation depends on lots of factors, as a law student, this paper focus on analyzing the impact of legal factors of IP. At first this paper analyzes the latest developments of the valuation of intellectual property research at home and abroad, and then decided to discuss the determination of intllectual property value, intellectual property valuation methods, the impact of new appraisal standards,with an emphasis on the impact from legal factors of different types of IP.This paper argues that the value of intellectual property rights determined by the effectiveness of the intellectual property. Many factors have great effect on the valuation of intellectual property , both legal factors, but also economic, technological and other factors. The choice of intellectual property valuation method has the flexibility to make the appropriate occasion decision which is based on the specific time and context. Different types of intellectual property have lots of differences on the legal characteristics, the assessment needs to focus on the differences of legal factors of differents types of IP which makes great changes on the valuation of IP.
