For the reform of criminal law worldwide, human rights protection has become one of the vivid themes of criminal law reform and criminal law exchange, which is bases on its intrinsic foundation but not accidental. As the symbol of the degree of civilization of a society, the situation of human rights is also a basic condition of it. With the conception of human rights deeply rooted among people, respecting and protecting human rights are more concerned and emphasized by the state, and the idea of human rights protection has become one vivid theme of contemporary criminal law. In our country, the'criminal law has carried out the idea of human rights protection and achieved lot with sustainable development. However, there are still something to be improved for its shortcoming. It plays a role of enlightenment and source of reference for strengthening and improving the human rights protection of criminal law in our country to research the issue of human rights protection of criminal law in Russia. Further, it also helps the exchange and cooperation of criminal law between the two countries for joint development and progress.As China and Russia have wide and profound contact and exchange on criminal law, the frame of current criminal law in our country takes "Legislation Outline of Criminal Law in Soviet and All the Union Republics" as original version. China and Russia had similar history and concepts of criminal law before, and confront to the issues of strengthening human rights protection of criminal law together. Starting from international human rights law, the author compared the regulations of human rights protection of criminal law in China and Russia, and found the source of reference which can be adopted.
