The Late Qing Dynasty Commercial Law Research Of Jinan Trade Port

Jinan, as the capital of Shandong is a typical feudal political city. In the early twentieth century, Jinan began its own process of modernization. In the late Qing Dynasty established a guiding principle "Self-opening". Jinan became the first Opening capital city in 1904. Shandong authorities Yuan Shikai and Zhou Fu opened Jinan, Zhoucun, and Weixian as the commercial port.As trade and economic developed, the commercial legal system also developed fully. Accumulated a large amount of literature information and practical experience. This dissertation is mainly about the system through this period of commercial law in Jinan. Provides the historical experience for the commercial law. This dissertation analyses seven parts of the legal process.Part one is about the"Self-opening"in late Qing Dynasty, and the press of German. Jinan needed to carry out the modernization programme.Part two is about the planning of the trade port. Shandong authorities Yuan Shikai and Zhou Fu opened Jinan, Zhoucun, and Weixian as the commercial port.Part three is the commercial law. The commercial law had three parts, the commercial legislation of Late Qing dynasty, Shandong, and Jinan commercial port.Part four is about the legal Property of Chamber and its characteristics from the Prospective of various subjects. On the basis of background of coming into being, the paper put more attentions to its dominant functions.Part five is named as informal legal system. There were four kinds of informal legal system. The first is the foreign merchant. Many foreign merchants came into jinan. There commercial activities and extensive experience produced a strong effect. The second is the church. They show our people a different world, the advanced western culture, especially advanced western legal thoughts. The third is the nature of the gang of the organization, and the last is big China merchants.In the circle of politics, although the industrial and commercial capitalists had the racial consciousness of retrieving benefit power and self-reliance patriotic, this kind of consciousness was suppressed because of the long-term confinement by the Shandong authorities. Another reason was their own class limitation which maked them seldom put forward the request to reform political system. Their politics activated mostly aim at the economic benefits of bourgeoisie. Even to imperialism, they had adopted different strategies based upon their own economic benefits. These limitations left the industrial and commercial capitalists of Jinan taking a vague and unstable attitude towards the revolution in the process of the democracy and national movement.In conclusion, 1904-1911 is a large development period for commercial law. All kinds of forces stay hear. It build a foundation of the future development of the commercial law in Jinan trade port.
