Research On Institutions Regulating Foreigners In Establishing The Free Trade Port For The Police Department

China's exploration on the construction of a Free Trade Port meets the requirements of a new system that is open to the outside world,attracts talents around the world to work in China,promotes the rapid development of Chinese service trading,and serves the economic construction in a better way.Ensuring the freedom and convenience of the flow of people is the basic feature of Free Trade Port and an important part of China's exploration and construction of free trade ports.Therefore,the mobility of people,especially monitoring the foreigners,is crucial for Free Trade Port.The ability of controlling and managing the foreigners overwhelmingly affects the construction and development of Free Trade Port.At present,the dilemma between the free flow of personnel and security control has become the prime obstacle for the public security management of foreigners in China's Pilot Free Trade Zones.In addition,the structural problems existing in the management system of foreigners in China make it impossible for the public security management of foreigners to better serve the construction of Free Trade Port.As the main administrative department,how to reform the managing system of foreigners that serves the construction of Free Trade Port and further,enhances the ability and level of the public security organs to maintain social security order,is a problem that needs to be focused by the police department,while giving full play to the function of public security and maintaining social security and stability.This paper takes the flow of personnel elements in the construction of Free Trade Port as the entry point.It concentrates on the concept of "natural person mobility" under the WTO Agreement on Trade in Services.It analyzes the problems arising from the contradiction between the personnel flow,the security control of the Free Trade Port construction,and the adaptability of the current Chinese public security foreigner management system to the Free Trade Port.Taking the opportunity of the establishment of the national immigration administration in China,this paper reconstructs the foreigner management system of the public security and puts forward countermeasures accordingly.First of all,we should accelerate the improvement of the legal system of free trade ports,clarify the management system,and improve the level of data sharing and application.We should accelerate the integration of the "big foreign administration" pattern by promoting the "three reciprocal" customs clearance mode,the "single window" construction,the alien identity certificate system,the establishment of the foreign-related public security prevention and control system,and the promotion of social participation to effectively link entry and exit,residence and employment.At the same time,we must combine the work of external management with community policing to actively promote the social integration of foreigners,and conduct police cooperation across regions and crossborder to effectively combat with criminal activities.In short,by establishing a public security foreigner management system basing on establishing a Free Trade Port,the free flow of foreigners can be energized under the premise of national security.
