Study On Brutal Law Enforcement And Its Prevention And Control Countermeasures

Recently, we can hear brutal law enforcement of the officers from the media from time to time. In their law enforcement activities, these Law enforcement officers breach statutory procedures, use brutal methods, and seriously infringe upon the legitimate rights and interests of citizens. This brutal law enforcement disrupts the normal social order, and contrary to the rule of law in China, the concept of a harmonious society. It is also harmful to the building of a good relationship between the Government and the citizens, and has a negative impact on maintaining social stability. Therefore, studying on the prevention and control countermeasures of brutal law enforcement and promotion of civilized law enforcement is of great significance to the construction of a service-oriented government and a harmonious society in China.The first part of this paper introduced the background and significance of this topic, in and abroad literatures and articles inspected in writing, researching methods and possible innovations. This part of the paper is preparing for the whole discussion.The second part of the paper outlined the meaning and role of law enforcement, and the meaning and identity of brutal enforcement. Administrative law enforcement plays a important role in protection and realization of human rights and the establishing and maintaining of social order. Brutal law enforcement is just a law enforcement that breach of statutory procedures and infringe human rights.The third part of this paper analyzed the main performance of brutal enforcement, reasons for its existence and its harm to social development. Currently, there is a lot of brutal law enforcement in urban management, land acquisition and demolition, traffic police enforcement etc. it undermined the social stability, and was harmful to the construction of a harmonious society and service-oriented government.The fourth part of this paper discussed in a comparative analysis way and studied from the United States, Germany, Japan, France to prevent and control brutal law enforcement. Main measures we can learn abroad were hearing process control, law enforcement accountability, supervision and improvement of law enforcement officers.The fifth part of the paper discussed the prevention and control countermeasures of brutal enforcement in China. We should make guidance in the soul, strengthen serving awareness of law enforcement officers, and work in a civilized way; we should strictly control the law enforcement procedures; we should strengthen the enforcement officers'individual accountabilities to constrains law enforcement activities; we should improve the quality of law enforcement officers to improve the quality of law enforcement; we should strengthen supervision over law enforcement to combat brutal law enforcement.The last part of the paper is conclusion. It reiterated the main points of the paper and point out that the brutal enforcement is a very complex problem, and it needs continuous studies of scholars to look for more effective prevention and control measures, and to build a harmonious society.
