Study On Sanitary Legislation In The Ealy Times Of The Nanjing National Government(1927-1937)

After the Nanjing national government founded, the establishment of the National Government is an important period in the history of modern legislation, and its legislative achievements is brilliant. Meanwhile, the Nanjing government established a fairly good sanitation legal system, which not only protect the health development at the time, but also maintained the ruling class regime .It is the Chinese legal system to the health an important part of modern development. However, studying on the rule of law specializing in modern health less, this article attempts to analyze the process of analyzing sanitary legislation about the early time of Nanjing national government.This article has the foreword , four chapters and the conclusion.The foreword briefly discusses significance of article and research methods, and briefly reviews academic history.The first chapter is about the social background of sanitary legislation in the early time of Nanjing national government. The contents of this chapter is mainly divided into three parts to describe. The first part briefly reviews the chinese ancient legal system of sanitation. China is a long history of state, chinese traditional culture of sanitary system must have a affect on modern sanitary legislation. The second part describes the germination of modern legal system of sanitation. With the effect on external power of countries and motivation of law's self-development,legislators'choice which is made between the chinese traditional law and the modern western law, promoted to form modernization of chinese law in modern times. And modernization of the chinese legal system must also facilitate the modernization of sanitary legal system. The third part briefly describes the trends of sanitary legislation in the world. Since modern times, the western countries firstly had established a modern sanitary legal system. If China wanted to set up its own sanitary legal system at that time, drawing on the outcome of advanced sanitary legislation would be a good channel.The second chapter analyzes concept of sanitary legislation in the early time of Nanjing national government. After the establishment of Nanjing national government, along with development of the whole society, the sanitary legislation made substantial progress. This chapter focuses on Sun Yat-sen'legislative guidance of three people's principle in the sanitary legislation and the principle of legislation at that specific historical circumstances .The third chapter analyzes the content of sanitary legislation in the early time of Nanjing national government. This period of sanitary legislation covered sanitary executive, public health, medical affairs, medicine affairs, food hygiene and medical education from the legislative structure respect. Sanitary executive is a foundation of managing health-care for the Nanjing national government , while it is also part of the government administrative system. Firstly Nanjing national government introduced sanitary administrative regulations, established from the central to local sanitary executive system, and defined the responsibilities of the relevant competent authorities. Secondly in order to improve urban construction and public health, strengthen the capacity of national the epidemic defence and improve people's health, the government had developed special regulations. Furthermore, in terms of legislation of medical and medicine affairs, it provided physicians, pharmacists and other medical personnel registered to practice system,medical institution in the registration management, drug companies and pharmaceutical management, ect. In addition, as to enhance food security, food materials, food materials utensils, milk and food additives should be standardized. Finally in order to strengthen sanitary personnel training, the government had legislated in the aspect of medical education.The fourth chapter evaluates sanitary legislation in the early time of Nanjing national government. According to analysis of content about sanitary legislation and regulation's implementation, the article summarizes the characteristics of sanitary legislation during this period from the macro-level. With the creation of a relatively complete legal system of sanitation, it promoted the development of health-care,and also laid the foundation of current sanitary legislation for Taiwan.Of course, there were deficiencies in the sanitary legislation such as chaotic legislative bodies, the lower level legislature and the poor implementation's results during the early time of Nanjing national government.Conclusion : Combining the current sanitary legal system problem faced by the construction process, in the process of sanitation legislation of the Nanjing national government based on the analysis and discussion ,I hope that I can get some inspiration.
