Nanjing National Government Constitutional Legislation Research

Constitutional legislation of the Nanjing Kuomintang government is an important attempt of the Chinese constitutional legislation in modern times. Not only was his form of a complete legal text of the Constitution, but also left a valuable historical experience of constitutional legislation, Therefore it is of high value for study. This paper attempts to combine theoretical and historical analysis. Traditional and modern, domestic and foreign development, forms and value were selected as analytical tools from typologies research paradigm, In this paper from the perspective of traditional and modern we study constitutional legislation of Nanjing Kuomintang government's ideological foundation, political foundation and economic foundation, combination of domestic and international environment from the perspective of domestic and foreign development we study the legislative process, from the perspective of forms and value we evaluate the legal text, the constitutional model and sum up the inspiration of the contemporary constitutional. This paper attempts a comprehensive study of Kuomintang government, reveals the historical inevitability behind phenomenon of constitutional law during this period. we also in light of the political, economic and ideological background to make objective and fair assessment for Nanjing government legislation on the constitutional objective, fair assessment for constitutional legislation of the Nanjing Kuomintang government, and draw some inspiration for the constitutional development in contemporary China.
