Research The Judicature Law Problem By The Community Corrects

A pilot project of Community Correction have been operated since 2003 in China, and it has made initial achievements and accumulated some experience in the aspect of theory and practice. However, there are still some problems and shortcomings in the work of Community Corrections which affecting the rehabilitation of offenders in community correction effect and hindered the development process of China's community correction.To solve these problems, we must be carefully analyzed judicial administrative authority of community corrections and made its ownership clearly . Administrative organization of justice carried out the right of community corrections has an advantage over these which combined with traditional experience in the rehabilitation of offenders, community corrections clear terms of reference of the judicial administrative authority and responsibility, and by correcting the rights and obligations of staff, referring to foreign community corrections legislation , the main body of useful experience and terms of reference of judicial and administrative bodies responsible for community corrections administration of justice and the difficulties with the facilities to improve the administration of justice, community corrections countermeasures.
