Research On Grassroots Judicial Work's Problems And Solutions Under The Background Of The Rule Of Law

The rule of law is the essential requirement and an important guarantee to uphold and develop socialism with Chinese characteristics,is the inevitable requirement to realize modernization of the management system and management ability,concerning our party in governing and rejuvenating,concerning people's happy life, concerning security of the party and state.The party's eighteen Fourth Plenary Session made major strategic to implement the rule of law fully,plenary session had been clear about the major task of promoting the rule of law: to improve the legal system of socialism with Chinese characteristics that is based on the Constitution as the core,to strengthen the implementation of the constitution,to promote administration according to law further,to speed up the construction of government under the rule of law,to ensure fair justice,to improve the judicial credibility, to raise the universal awareness of rule of law, to promote the construction of the society with rule of law,to strengthen the construction of the working group of the rule of law,to strengthen and improve party leadership on promoting the rule of law.This is the party's plenary session first dedicated to the rule of law studies, decided that "comprehensively promote the rule of law, the overall goal is to build socialism with Chinese characteristics system of rule of law and building a socialist country ruled by law." Plenary session has carried on the comprehensive deployment to promote the rule of law principle, task, layout at the same time.In this paper, starting from the background of the rule of law, illustrates the theoretical and practical significance of the study;the second for defining the relevant concepts, and reviewing and summarizing the rule of law theory and practice,in order to gain the research framework of this article. the core of the study is to solve the current dilemma faced by grassroots judicial work,according to laws and regulations, system requirements and relevant information,analyzing and summarizing the cause and existing problems of the restriction of grassroots judicial work,and combining with actual, put forward comprehensive implementation countermeasures and suggestions to promote the rule of law concept in grassroots judicial work.The paper can be summarized as the following five parts:The first part describes the purpose and significance of this thesis.By collating related literature and reviewing the research status at home and abroad, and it gives research methods and innovation of the paper.The second part, starting from the basic meaning of the rule of law, basic content, the development course of the rule of law and judicial work involves the related theory, law and the judicial function has made the explanation, lay the foundation for follow-up study.The third part, analyzing the plight of the grassroots judicial work, too much functions and responsible of grassroots judicial offices and inefficient management system, lack of funds, establishment, office space, office facilities and so on.The fourth part analyzes the factors restricting the rule of law concept implemented in the current grass-roots judicial work, this paper analyzes the restricted sense of awareness, legal legislative, institutional support, professional development and other factors.The fifth part, to research on suggestions to promote the judicial work,to analyze how to improve legislation, the establishment of community correction police, the implementation of the safeguards to get rid of the disadvantages of the rule of law restricting the concept to achieve.
