Research On The Functioning Of Community Corrections In Judicial Offices

Community correction is an important system of penalty execution system in China.Community correction aims to prevent crime and maintain social stability by re socializing the objects of community correction and reshaping their correct values and outlook on life.The realization of the basic purpose of community correction depends on the effective operation of community correction function.In practice,the implementation of community correction work is mainly in the judicial office.The operation of community correction function of judicial office is directly related to whether the basic purpose of community correction can be achieved.Although the operation of the community correction function of the judicial institute is guaranteed by the community correction law at the legislative level,and the operation modes of Shanghai,Beijing and Zhejiang are explored in practice,there are still many problems to be solved due to the influence of many factors in the operation of the community correction function in practice.Taking R judicial institute in L District of S City as the research object,this paper other research methods to analyze and study the operation status,operation difficulties and causes of the difficulties of the community correction function of the judicial institute,and puts forward countermeasures and suggestions to improve the operation of the community correction function of the judicial institute.The thesis is divided into four chapters.The first part mainly defines the relevant concepts,defines the concept of judicial office,community correction,community correction function,and analyzes the theoretical basis adopted in this paper.The second part takes R judicial office in L District of S City as an example,first introduces the basic situation of community correction objects,participants,basic guarantee,working mechanism,etc.in the community correction work of R judicial office,analyzes the current situation of community correction function operation of judicial office from three aspects: punishment effect,re socialization effect,warning and crime prevention effect of community correction objects.The third part describes the difficulties in the operation of the community correction function of the R judicial institute and the main reasons for the difficulties,including the formalization of the system,the lack of public services provided by the judicial institute,the serious administrative color of the work,the poor connectionbetween the member units,the lack of professional and stable correction team.The fourth part puts forward some ideas and suggestions,including: first,to build and improve the legal system of community correction;second,to deepen the reform of the judicial management system;third,to strengthen the construction of community correction team;fourth,to promote the socialization of community correction work.Through the empirical research of R judicial institute in L District of S City,this paper tries to see through the macro community correction function operation of the judicial institute,combine the micro analysis with the macro theory,and try to provide the targeted beneficial opinions for R judicial institute,and provide the general suggestions and opinions for the community correction function operation of the judicial institute.
