On Studies Of Legislation Concerning Regional Restricted Approval System

Regional restricted approval system is the administrative penalty measure stimulated by State Environmental Protection Administration to deal with the severe environmental problem of relative regions and enterprises, which has played a significant role on the environmental execution. However, it is still in lack of relative legal basis in practice. Especially as the regional restricted approval is an benefit invasion act and lacks relative legal basis, it violates our country's law concept of administration according to law and is in conflict of the rules of the "Administrative Punishment Law". This article gives a systematic analysis and scientific regulation on the problems like suitable condition, remedy, procedure and so on through the research of regional restricted approval. In order to provide a satisfactory countermeasure on coordinating economic society development and environmental protection, and the "regional restricted approval" is an innovation in the aspect of improving enforcement mechanisms of environmental law.This paper consists of five chapters to anlysis the regional restrictions system, the first chapter of provides the related literature review and clarifies the innovation of this paper from the background,; the second chapter anlysises the concept and the nature of regional restrictions, also introduces the theoretical and practical significance of the system; third chapter analyzes the existing legal provisions and implementation of the regional and the status of the system approved; Chapter Four of the regional restrained system analysises legislation, law enforcement, judicial shortcomings, specifically the current problems; Chapter five presents a advise for the perfect proposal, only through the establishment of related systems and modification to improve this system, to embody China's basic national policy of administration according to law.Regional restriction,a new measure to the environmental protection played a significant role in resolving the contradictions of economic development and environmental protectionin the current environmental protection, ecological civilization construction, more fully legal research is badly needed in order to make the system to play its role, the base is layed so that the system become a basic system of environmental protection foundation.
