China is a socialism country of democracy, which gives its citizens wide range of democratic rights. Based on this idea, colleges in our country carry on a system of democratic decision-making. For example, Congress of Faculty Members and Academic Council are the main form to exercise democratic rights as well as school's decisions. However, in reality, these two groups haven't the capability to protect teachers'holy rights which they have signed initially. Real power still mastered by administrators, the agents who have invested on the school. College faculty's participation of decision-making is a failure in reality along with the resulting lopsided structure and barely satisfactory run status of university decision-making power.In the economic field, as the development of human capital theory, people pay much attention to the effect of it. For a corporation, the subject of human capital has gained an equal status to control the community gradually. The property rights of human capital has realized accordingly. Thus, this kind of employee-shared and participated decision-making process has increased the productive and promotes the developing of a company. As a group of a galaxy of intelligent, in college, teacher's human capital should pay more attention. Because of this, through analyzing, this paper is intended to demonstrate that college faculty has an equal status and natural rights to participate the decision making process in college, and their final rights should be reflected by their decision making power. Based on this, college decision-making distribution would be optimized from the two points of system and institution and a third party of supervision authorities would be launched to supervise the unites of Congress of Faculty Members and Academic Council, their meeting agenda, the validity of voting formula, etc. All of these can ensure a good participate of teachers and an effective running of the decision-making. This paper thinks that it will be more powerful to explain the teacher's rights to participate the decision-making system by the human capital property theory. A college decision-making structure that based on the principles of that relationship with Human Capital Property Rights and college decision-making can strengthen teachers'ability to take part in school's decision-making process and can deepen teachers' capital rights consciousness. It can be regarded as both theoretical and practical way to solve the "administrative monopoly" situation in Chinese college.
