The Study Of The Cooperative Education Statute

Cooperative Education is the common current of the development of the international engneering education. Cooperative Education have the great realistic significance to developing of higher education and economy. But if Cooperative Education continue to popularize and develop, interest mechanism must be built which is mutual benefit, and government should control Cooperative Education by law. Though there is a series of statutes such as and etc in china, there isn't special statue which regulate Cooperative Education. The reason that lead to this thing is that the theory of education law is not perfect, and that social relationship is too complicated to put in order. In this article, the statute of Cooperative Education is discussed innovatively on the basis of experience of Cooperative Education board and abroad and of overseas legislation.Cooperative Education statute is an important component part of education law. But because of defect in the education law, for discussing Cooperative Education statute, firstly, I analyze the essential theory of education statute. Especially I analyze legal position of education law and social relation that education law regulates. Secondly by comparing the statute of our country with foreign one, the difference is found out. Thirdly education contract and the relation of Cooperative Education law are discussed. Finally, based on the different subject that statute face to, the author analyze and sum up macroscopic statute of China, statute facing to the college, to the enterprise and to the college student. The proposals are tabled that our country should constitute statute of Cooperative Education and how Cooperative Education is carried into execution.The innovative point is following. Firstly education law is the independent branch of law, and is one of the fundamental branches of law. And the relation between investor of education and educator is discussed.
