The continuous deepening of education reform has provided a good external environment for the development of modern vocational education."Rational education according to law" and "governing schools according to law" are the rational choices of China's educational governance under the background of education reform.Education moves from "man rule" to "rule of law" It is the requirement of education modernization and reflects the transformation of education from tradition to modernity.As an important part of the national governance system,the construction of the vocational education governance system is striving to the educational path of the rule of law.Based on the clarification of the regulations of higher vocational colleges and the governance concepts of higher vocational colleges,this study aims to grasp the logical relationship between the two,analyze the governance reality of higher vocational colleges based on the statute,and explore the higher vocational colleges based on the statute.Governance operation mechanism;try to reveal the essence of internal governance structure of higher vocational colleges in China,and fully consider the complexity and modernity of modern vocational education governance,study the governance problems of higher vocational colleges based on regulations,and explore higher vocational colleges The school's rule of law path to effectively protect the governance effect and respond to changing environmental challenges.Based on the research purpose,this study mainly uses the combination of literature research method,text analysis method and investigation research method.From the perspective of contract theory,it demonstrates the meaning of governing higher vocational colleges based on the statute,and explains the regulation of contract on the governance of higher vocational colleges.Based on this,it analyzes the "missing" dilemma of the governance of higher vocational colleges based on the statute,highlighting the practical problems of governance.Under the premise of governing higher vocational colleges according to the contract,this paper explores the ideas of governance improvement in higher vocational colleges based on the statute,proposes specific suggestions for improvement or opinions,and constructs the governance framework structure of higher vocational colleges based on the statute under the intention of deepening reform.The main conclusions of this study are as follows: First,government failure,market failure,and the theory and experience of institutional autonomy indicate that the governance of vocational colleges based on the statute is the rule of law in the governance of modern vocational colleges;second,the statute is the rule of relations.Collection and characterization are the contract based on negotiation between the contractor of higher vocational colleges and other stakeholders.The statutes reflect the relationship rules of governance,the statutes have regulations on governance,and the nature of governance based on the statutes is contract governance.Third,the governance status of higher vocational colleges based on the statutes is “orderly” and“orderly”.The system construction,system construction and goal alienation of governance are the reasons for the “out of order” of governance.Fourthly,the institutionalization process of the governance of higher vocational colleges based on the statute is contractual regulation.Multiple equilibrium,the internal governance structure of higher vocational colleges is the power game of stakeholders' participation in governance;fifthly,the strategy of governance improvement is explored from the three governance degrees of quality and efficiency,multigovernance and supervision and evaluation,and higher-level occupation based on regulations is proposed.Institutional governance can be improved by providing contract-based institutionalized governance norms and procedures,governance interactions of democratic participation,and multi-channel supervision and governance effectiveness.
