In the 21st century, the economic competition among countries has been becoming more and more fierce, in which education is playing a more and more important role. Therefore, almost all countries attach great importance to the construction of teaching staff and regard it as a means of improving teaching quality. Nowadays, with China's entry into the World Trade Organization, the demand of talents in the eyes of both quality and quantity is enlarging; meanwhile, a great many problems need solving immediately about the teaching staff in primary and middle schools, among which is how to carry out the reform of hiring teachers, namely teachers hiring contract. It is a contract signed between concerned teachers and education administrative departments. In China, as the theme of teachers hiring system, teachers hiring contract should be paid importance to by relevant education departments, the importance of whose perfection has been also proved by the author's teaching experience. On the basis of documents analysis, visits and surveys, the article is devoted to the problems of teachers hiring contract and their possible solutions.Firstly, the article will talk about the problems of teachers hiring contract. Looking back at the personnel system of education departments, it can be concluded that the working relationship in schools is coming in the direction of market and agreement but there are no relevant regulations or laws to bind this process. Naturally, some issues in teachers hiring contract can not be neglected, such as the weak contract consciousness of both teachers and schools, which makes the contract a single-party document; the uncertainty of teachers' status, which leads to the difficulty of applying laws and the uncertainty of helping means; the simple content and the uncertainty of rights and obligations, which are caused by the nonexistence of relevant laws; the responsibility of failing to obey the contract and relevant means of dealing with it.Secondly, the article will discuss the possible solution to these issues. How to lawfully guarantee the implementation of teachers hiring system and achieve the successful transfer of relationship between schools or education administrative departments and teachers, especially how to regulate schools' behavior and protect teachers' lawful interests through hiring contracts, is worth paying attention to and demands immediate solution, the reason of which lies in that it decides whether teachers hiring system can succeed or not. From the possibility analysis of regarding teachers' lawful status as civilian servant, the benefits of implementing civilian servant system upon teachers are explained; some suggestions will be put forward about contract content, the establishment of life-long teacher status, firing details, disagreement-solving measures and so on; some views are expressed about educationlaws system needed in building reasonable supporting system of the contract and establishing perfect teachers hiring contract.Entitled as Research on Teachers Hiring Contract in Primary and Middle schools, the paper analyzes and studies the content of teachers hiring contract and its concerned issues. Combining different characteristics of law and education, referring to teachers hiring contract in other countries while taking into our own situation, the paper proposes some meaning suggestions with the purpose of perfecting the contract and making it function in the process of spreading teachers hiring system.
