The problem of protecting peasant workers' rights is an important social problem in the period of China transformation. The thesis tries to describe the present conditions about peasant workers' rights and interests based on the former studies. It reveals the discourse and power of damaging the rights and interests of peasant workers in the perspective of interaction between action and structure. It discovers and analyzes the defending action for the survival space built by the discourse and power though first-hand investigation. It exhibits the logic of defending action and draws a picture of education and punishment, conspiracy and resistance by making use of first-hand materials.The thesis has seven parts:The first part is the introduction, including four semi-parts: raising the question, bibliography, research route, research target, research method, and defining concepts. The paper argues that there are two disadvantages in recent studies on the action of defending peasant workers' rights. Firstly, peasant workers haven't been regarded as the main power in this defending action. Secondly, the connection between the action and the structure has been neglected in those researches. The author is concerned about the restriction of the system against the defending action, and he is also cared about the self-motility of peasant workers facing the losing rights. The article reveals the process of the peasant workers defending their rights from the point of view of the interaction of peasants, capital, and local governments.The second part analyzes the present condition of peasant workers' rights from many aspects. The paper finds that peasant workers' rights have been damaged in many segments, such as, job-hunting, labor condition, political rights, human dignity, education rights, social security etc.The third part discusses the main reason and inner-logic of the defending action. It points out the survival problem is the key and the ethic of survival in the peasant workers' notions is related to the action.The fourth part concluded four types of defending action. First of all, legal resistance includes formal inner-system ways, for example, conciliation by the labor union, labor arbitration, inquiry to the government etc. Secondly, illegal resistance includes the aberration behavior, such as beating or killing the employers, stealing or robbing. Thirdly, resistance in the ordinary lives, like out of line behaviors and weapons for the disadvantages. Fourth, resistance in the institution, that is to say, the migration among provinces. The fifth part prevails the process of the defending action, focusing on the interaction strategy among the three powers: peasant workers, capital, and local governments. The strategy of peasant workers is to appeal to sympathy and joining of the other classes through the social networks. Employers face the challenge of the peasant workers by compromise, weakening, and embracing. The local governments solve the obstacles arising by the disputes through a method of un-do and oppressing. This attitude shows the inactive, even bad will gesture of the local government, as the influence of "capital priority" hidden rules.The sixth part points out the consequences and the influences of the defending action. The result has two aspects: one is that peasant workers could defend their rights in the micro level. The other is that the institution has been modified and improved through the action in the macro level. The influence also has two segments: one is that peasant workers express enquiry of their legal rights and gain the experiences of the justice struggling. The other one is to triggering the awareness of rights among other classes and to drive the development of society.The seventh part is the summary. In a word, the author suggests that some behaviors harm the peasant workers' survival environments, such as delaying salaries and injuries violation. In reality, some factors make the commissions of the defending action hard to achieve, such as, rupture of the law discourse and the practice of law, the huge cost of suing, function failure of labor union, lack of unite action ability. As a matter of fact, the defending action is embedded in the network knitted by peasant workers, capital, and local governments. On one hand, peasant workers constantly use their activity to defend their rights with mobilizing all kinds of sources and strategies. Therefore, overall, the defending action represents an interaction process of action and structure. Finally, this article predicts some social influences and counter-measurements for maintaining the rights of peasant workers if their rights can't be preserved.
