Studied law from legal efficacy perspective, it can help us to observe law from broader space and time, and then developing the society function of law more sufficiently. With our country West Development propulsion, how much better developing education for ethnic, pushing forward economic and social development of western part territory of nationality, protecting culture diversity, guaranteeing national minorities' rights for living and developing, building harmonious society, safeguarding national unification have very important and significance. Therefore, we must know significance of nation educational legislation from strategy perspective; adopt effective measure, pushing forward the nation educational legislation's further. Yunnan Province Xishuangbanna Dai Minority Autonomous Prefecture has unique characteristics such as peculiar geographic location, various ethnic culture and unique "temple education", so choosing to study "Yunnan Province Xishuangbanna Dai Minority Autonomous Prefecture Educational Item" (abbreviated "Item") has certain theory and practice significance.The thesis use the angle from legal efficacy of the item to be researched since our country does not have comparatively unified valuation standard at present to this aspect, therefore the thesis built out the valuation system to legal efficacy in terms of the academic foundation of the jurisprudence and the content of the item. This valuation system has included legislation purpose realization, right duty exercising mainly, the legal liability bearing it puts and practice as well as relieving four parts.The thesis has been conducted an investigation into Xishuangbanna and quoted statistical data to evaluated the active effect to the item. There were arrived " nine years education at universally" and promoted multiplex culture developing. Then, pointed out the problems and their cause about: By the legislation basis and the objective basis have changed, the item Already more and more can't adapted the new period of ethnic education request going ahead; In putting process into practice, because of the clause leading cause such as being aware of lack and educating fund is difficult to carry out, so the item is not carried out even; the item must have some more rules about how to change the "theory of education is no use" and how to succeed the ethnic culture and so on..Specifically for have problem and cause, the author has submitted three aspect suggestion: firstly, revising the item adjustment version structure and perfect version content ; secondly, intensify efforts to enforce the law when carry out the item into effect; thirdly, change people's thought mental consciousness , build the overall situation developing education for ethnicity.There were have many factors affecting one law, both and realize including that item self also including executive condition , still having entire society overall situation law to this aspect. At present, the local government already sets about the job starting revising being in progress the item. We must looks for allowing asking about the real problems about ethnic education only, we can solve their.
