This dissertation discusses the equity of compulsory education theoretically and practically from the view of jurisprudence, it takes the jurisprudence as it's logical beginning and ends in the value choice and the system construction of the compulsory education.This dissertation defines the connotation of the educational equity on the basis of Rawls' justice principle, which sees equity as a combination of regularity and purpose and an ideal and a system that social members are distributed equally according to the ratio and also a guarantee system on relief. The purpose of choosing the correlation of equity and justice to clarify the equity is to find the joint between equity and system. On this basis, this dissertation discusses the relative theories on educational equity, including analysis of relative definitions, types of educational equity, and then it elaborates on connotation of educational equity, and the three legal principles-equity, difference and compensation, later it discusses law system of Chinese compulsory education and analyzes legally the new-mended compulsory educational law.Based on this, dissertation analyzes the unfair phenomena of present compulsory education among the different places, schools, classes and genders. The interior and exterior reasons mainly refer to politician, economy, traditional culture and education system, which includes guiding concept of managing school, content of teaching and the quality of teachers.Implementing the equity of compulsory education needs a long way to go. As state legal education, it should be discussed deeply from the aspect of system. This dissertation discuses system guarantee of Chinese compulsory educational equity from three aspects: First, education fundamental system; Second, educational basic system; Third, the specific system, refers to regulations of educational conduct. According to this logic, this dissertation provides a thought of implementing the compulsory educational equity at the macro, moderate and micro aspects.At the macro aspect, gasp Chinese educational policy, which persist that education must serve the needs of socialist modernization, be integrated with productive labor, and train builders and successors who are well developed morally, intellectuall and physically, is the foundation to understand the system guarantee of compulsory education, this aspect provides premise of system and guarantee for smooth and fair development of compulsory education. At the moderate aspect, it mainly focuses on legal systems which guarantee the equal development of the compulsory education, elaborates on legality of educational relationship, educational conduct and educational development, place Chinese compulsory education into a legal track. At the same time, set up financial transfer payment system, shorten the regional disparity of compulsory education; guarantee disadvantaged people to be educated under compensatory policy; adjust present compulsory educational pattern, allocate educational resource reasonably. At the micro aspect, this dissertation suggests that through reforming assessing method and strengthening school educational management to make micro education tend to fair.
