Problem Of Societies Regulation And Intervening Professional Soccer Referee In China And Foreign Countries Under The Ideal Of The Law

Western concept of the rule of law in a long history both in theory and in practice have made brilliant achievements. It is in sports, especially in professional football referee system of organization and management associations regulation and judicial intervention is the use of the system easier. Our national advocacy "of the rule of law", but how to approach the rule of law is not much of it. This paper hopes of the West to explore the concept of the rule of law to its advantages in the sports of football referees sector in the organization and management systems provide and learn from the role.This paper through literature, Questionnaire survey, mathematical statistics and comparative study of method , mainly in the following aspects of China's professional soccer referees on the organization and management system to study:(1) meaning of the concept of the rule of law.(2) manifestation of the rule of law In sports domain. (3) Chinese and foreign Soccer association's nature. (4) Chinese and foreign professional football clubs legal nature. (5) Chinese and foreign soccer referee in the organization and management system.(6) Chinese and foreign soccer referee judicial intervention system.The results of this study:(1) China's professional soccer referees relevant organizations of the existing management system and the modern concept of the rule of law and our country's "rule of law" in the fundamental policy is not in line with. Societies in regulation and judicial intervention in practice and failed to convince the people and the legitimate desired results.(2) Western countries mainly professional football professional football referees related organization and management system for the concept of the rule of law embodied Societies Regulation System, and promote the healthy development of football. Particularly in the judicial intervention be reflected in the Societies Regulation Theory more mature and reasonable.(3) Our country professional soccer at present not the reasonable legitimate establishment sports mass organization system, the corresponding judicial involvement theory and the practice have not had the full legal persuasive power.According to the results of this study proposals :(1) a profound understanding "of the rule of law" contained in the overall thinking and the various components of the Chinese professional soccer referee in the organization and management of the system(2) In the Chinese professional soccer referee management system to establish a free and democratic societies autonomy in sports(3) a magistrate the solution to the problem should be in accordance with the autonomy to consider the mode of Societies to resolve, further consider the use of civil law, and then consider the use of criminal law to solve the model.
