Study On The Legal System Of The Management Of The University Scientific Research

The management of scientific research in the institutions for higher education has a direct impact on the level of their humanities and social sciences research. However, there are a lot of management problems. Based on the management system of the high learning scientific research for the study, this paper focuses on the management of personnel, funds, management issues and the outcome of the social science research to start, and proposes the relevant recommendations of the rule of law combined with the related "Higher Education Act". In addition to the Introduction, the full text is divided into five sections.First, this paper mainly analyzes the meaning, features, value of the objectives and principles of scientific research management system of institutions for higher education, aiming to provide the basic understanding of the theory about the management system of scientific research in the institutions for higher education. The second part, the author discusses the status quo of the management system of scientific research in the institutions for higher education, and then further expounds its specific objectives and values. The third part, the author analyzes the legislation and practice relating to the scientific research management systems among the United States, Britain, and Germany colleges and universities in a comparative way. The fourth part, through the comparative research on these systems in above-mentioned countries, the author finds that China's management system of scientific research in institutions for higher education primarily has following problems: The purpose value is not clear, and the principle of proceeding from reality can not be implemented; the management mechanism is rather passive, and the focus is not prominent; the management system with limited integration deviates from the fairness and rationality; the mechanisms is lack of coordination; the research appears to be more of a utilitarian; as well as the quality of the management of scientific research needs to be raised. The fifth part, the author analyzes the causation of the existing problems in the management of scientific research in the institutions for higher education, and puts forward that the management should be made a comprehensive legal system construction by modifying the "Higher Education Act" on the management of the main body, funds, procedures of the scientific research management in the institutions for higher education, as well as the relationship between teaching and research.
