Intellectual property legal system provides protection for developing and utilizing knowledge recourses.It encour ages innovation,m aximizes the benefits of producing knowledge,and promotes economic and social development by authorizing appropriate rights to author ship,and determining the power relationship between knowledge creator and knowledge user.In the knowledge economy era,universities have become one of the m ost important powers in knowledge innovation and technology development around the world.Univer sity teachers have taken the m ost active roles in knowledge production and technology innovation.Based on IP legal system and its functions,th is paper will ex amine the research en vironment of university teachers,analyze the reasons for and scale of the impact of IP legal system on college teachers' research work.This paper will also try to examine the efficiency of the application of IP legal system from three aspects: research top ic selection,research quality and quantity,and IP protection awareness,and give a fair evaluation of the impact of IP legal system on research work.Based on the result of this research,this paper will con clude with suggestions and im plications for university administrators.There are three im portant aspects of IP legal system.First,IP legal system provides a new way of author izing property right.Through giving property right to innovation product ow ner,it allow s owners to use their products and benefit from their own work.Second,IP legal system provides a new incentive system for innovation.Through legal protection of creator s' benefits,it encourages people to commit in innovation.Third,IP legal system protects intellectual work and innovation behavior.Through clearly determined ownership rights,intellectual work producers and their productions will be protected.The functional theories of IP legal system believes that can m aximize the benefits of producing knowledge,im prove research innovation standard,and prom ote collaboration of industry,schools and research institute,it is possib le that I P legal syystem can af fect research work of college teachers.As the mission of university changes thr ough time,university teachers' research work show different characteristics.At th e beginning,university's first priority is to teach knowledge,doing research is teach er's own interest rather th an an important aspect of university's mission.However,as the importance of research work grows in academia,encouraging research has become an integral component of university's job.Research capability als o becomes a pre-requisite for university teachers.In 20 th century,knowledge brings productivity,and research innovation accelerates economic growth.Because of strong research capab ilities and go od research environment,university has become one of the m ain forces that drives econom ic growth.Serving society has becom e the new m ission of uni versity.In o rder to b etter serve the innovation need of the s ociety,university teachers not only need to reach significant research outcome,their research products should also be able to converted into productive forces.The motivation for doing re search is no longe r merely driven by teachers' own interests,but m ore by the n eed of the society.People used to suppose that doing research is pur e and not for profit behavior,but now research is increasingly motivates by business opportuni ty and m oney.Doing research is no longer a voluntary behavior,but is obligatory under university policy.The change in research work,on the one hand,is because of the need of economic development.On the other hand,it is because of the implementation of intellectual property law.Standardization,protection and incentive sy stem provide the theoretical basis for why IP legal system has an i mpact on university teachers' research work.The direc t influence of the implementation of IP legal system includes: Change in assessm ent and rewarding system of research product,change in research funding and research goal,large increase in number of applic ations of IP and num ber of application approval.For individual teachers,the research they are conducting represents their thoughts and interests.Law should not influence teac hers' intent to conduct research and their research direction.It cannot force them to conduct research but to provide protection and encouragement to guide them towards the goal of the law.Whether intellectual property law successfully gui des teachers and reaches the anticipated goal requires empirical evidence to support.Using questionna ire and data analysis,this paper finds out that IP legal system goal of m aximizing benefits of IP is dif ferent from the teachers' goal of conducting research.In f act,in terms of increasing the quantity an d quality of research,IP legal system failed to give tea chers the s ame incentives as companies usually give.In term s of protect ion awareness,IP legal s ystem raised teacher's awareness to some degree,but usually university teachers regardless of fields and schools are reluctant to use ad ministrative proceedings to protect their intellectual property.In order to increase the impact of IP legal system,encourage teachers to actively participate in research and innovation,unive rsities should help teachers im proveing their protect awarenes s of IP.Universities should also train intellectual property management professionals,strengthen in centive system,as well as m inimize the negative impact of IP legal systemon teachers.
