The Research Of Procedure Of Social Assistance

As an important part of social security, social assistant is at the base network to secure the life of residents. It is irreplaceable in modern life. The rationality of assistant process is not only the mark of the level of civilization of a country, and it is also the legal protection to guarantee the social assistant being implemented effectively. The passage includes four parts as following:The first part discusses the meaning,characteristic and value of social assistance and social assistant process. Through the analysis of the meaning and characteristic, the author concludes the value that showed during the process.The second part starts from discussing the basic theory of administrated process, then exploring the principle of open, fair, just, due process of law, and proportion etc and the law of accepting, application, impartation, evidence, hearing, electronic government affairs, time limited, delivery. The author hopes that the fair and just can be realized through the principles and law.The third part analyses the main social assistant process in China accorded to the law already existed.The last part discovers the problems in our social assistant process through a case——"insurance deceit in ". So, in order to perfect the safe net to basic life, it must rebuild social assistant process. Through the analysis of case and three part above, the author gives some suggestions about social assistant process in China, and hopes that can be given some suggestions to legal instruction on social assistant process.
