Reward and disciplinary system of teachers is an important component of University Human Resources Management. Thereinto, the discipline against teachers' disciplinary offence or dereliction of duty is related to the normal teaching order and the development of teachers, which is extraordinarily substantial for universities and colleges to strengthen internal management, improve management efficiency and enhance the teaching quality. Therefore, the disciplinary system of teachers in universities and colleges is an essential requirement to run school affairs according to law and to regulate the internal management system of universities and colleges. Based on the existing research results, using the methods of literature, investigation and case analysis, the research focuses on the following three aspects:1. The problem existing in the disciplinary system of universities and colleges and the reason. Through investigation and analysis on the disciplinary system of some domestic universities and colleges, a general situation and common characteristic can be found that there are concrete problems existing on the concept of discipline, the criteria for application, the form of discipline and the remedy besides the lack of laws and regulations on the disciplinary system to rely on.2. The legal issues involved in the disciplinary system of teachers in universities and colleges. The legal status of teachers in universities and colleges determines the management to teachers and the protection of teachers' rights and interests. However, much controversy exists on the confirmation of the legal status of universities and colleges and so does the legal relationship between teachers and universities and colleges.3. The establishment of a rational disciplinary system of teachers in universities and colleges. During the process of rationally applying the disciplinary system to the internal management of universities and colleges, neither should the disciplinary ordinance of public servant be copied, nor is it supposed to apply the methods of enterprise management completely. To constitute a rational disciplinary system of teachers in universities and colleges, the occupational characteristics of teachers and the management traits of universities and colleges should be taken into account.The research suggests, under the currently legal frame, from the view of the engagement relationship between schools and teachers, it is supposed to apply labor contract law to find legal references to the disciplinary system of teachers in universities and colleges before the release of a special law on the management of staff in public institutions. The research gives opinions that, under the headline of confirming the rights and obligations between teachers and schools, the concrete disciplinary system should be devised according to the principle of discipline, the object of discipline, the range of discipline, the form of discipline, the institution to execute the discipline and the process of execution, the remedy system against the discipline, etc.
