With the increasing demand for knowledge and rights, learning rights and interests, as a basic right for human beings, especially for students, attract more and more attentions recently. The protection of student's learning rights and interests is regarded as the key requirement for Essential-Quality-Oriented Education, as well as the tendency of educational reformation worldwide. The protection of student's learning rights and interests is the core part of educational management according to the law and also the primary goal of educational management. The protection of student's learning rights and interests is critical for meeting the student's learning demand, the psychological and physical maturation of the students, and the reformation and development of education. Compared to the students in the countryside, the middle students in metropolitan areas have more learning demand, heavier learning burden and pressure, therefore, the protection of their learning rights and interests is highly important.This study is based on the questionnaire survey and communication with the middle school students from five schools in the Shapingba district of Chongqing. The questionnaire was basically carried out on three aspects, including the understanding of the protection of learning rights and interests, the current status of the protection of student's learning right, and the remedy of student's learning rights. The focus of this investigation is on the understanding of the current status of student's learning rights and interests protection, which consists of the protection of learning conditions, the learning freedom and the right of personality development. To further understand the degree of the protection of student's learning rights and interests, the learning demand of students was also preliminarily investigated.Our study indicates that the protection of learning rights and interests for the middle school students in metropolitan area is not as optimistic as we expected. There are three major issues in the protection of student's learning rights and interests, including the poor protection of student's learning rights and interests, excessive limitations on learning freedom, limited space for personal development. The students lack desire for independent learning and personal development because their learning demand is not well met. There are many reasons for the poorly-protected learning rights and interests for the students, including, imperfect educational laws and evaluation system, outdated educational concepts and methodologies, poor learning consciousness of the students, and inconsistent educational concepts of the parents. Based on the problems above, four strategies are proposed to improve the protection of students'learning interests and rights. These strategies mainly are improving the education law and evaluation system, improving the qualifications of teachers, and strengthening the communication between the parents and the school.
