Nowadays, China's higher education has been closed to perfection after development and reform for 30 years. Our higher education have made tremendous achievements in all aspects. By summarizing the reality and recalling the history of the higher education a lot of good results can be found, but a few shortcomings can be found too. Among these questions, the security of legal rights were concerned by more and more people. Because there is some defects on this issue in our higher education, many disputes about main body's legal rights occur frequently in higher education. To improve this situation,we must explore the solution by consulting predecessors' experiences and Combining it with practical problems.Given this situation, we will combine the theory of higher education with Philosophy of right in this study,and we will discuss Humboldt's educational thought which based on the philosophy of right. Humboldt firstly combined the theory of higher education with the philosophy of right,and applied it to the practice of education reform which obtained good results. His claims of education have important implications in improving the legal rights' safeguarding mechanism of the higher education. Humboldt's ideas inherited the essence of the theory advanced by Rousseau, Kant, Fichte and others. Describing the development of Humboldt's ideas and analysing the antecedent of his educational thoughts will be beneficial to explore the internal relation of the ideas between Education and Philosophy of right. At the same time, in order to evaluate the Humboldt's educational thoughts objectively, it is necessary to re-examine his educational thoughts in the angle of Marxist. In short, exploring the value of Humboldt's educational thoughts and providing suggestions for the practical problems will be the ultimate goal of this study.
