From the1980s, the Communist Part of Vietnam recognized that the Partyshould unite the whole nation, develop commodity economy, carry out a foreignpolicy of independence, sovereignty, peace, friendship and cooperation with allnations, in order to build socialism and defend their socialist homeland. In order toset the innovational route and achievements down, the Communist Party of Vietnamraised the task to form new constitution on the7thparty congress.In1992, the National Assembly of the Socialist Republic of Vietnam amendedand supplemented the1980Constitution, this supplied a law base to the line ofinnovation. At the end of2001, the10thNational Assembly of Vietnam wrote thecontents about “law-governed socialist State” and “markets of all kinds along thesocialist orientation” in the constitution according to the spirit of the9thpartycongress., this is beneficial to economical development.This paper is consisted of introduction, four chapters and conclusion.The Introduction discusses definition of some concepts, research significance,research review, research priorities, difficulty and innovation, research methods andthesis structure arrangements.The first chapter discusses the historical background of the1992Constitution.The second chapter analyzes the Amendments and Supplements to a number ofArticles of the1980Constitution, including political system, economical system,citizen’s basic rights and duties, the National Institutions, including the NationalAssembly, the State President, the Government and other institutions.The third chapter researches the nature of the1992Constitution, and analyzesthe influences to the reform and opening of Vietnam.The fourth chapter discusses the background, main contents and meanings ofthe2001amendments and describes the situation of the1992Constitution in lawfulcourse of Vietnam.The conclusion summarizes the preceding main contents and analyzes simply the five factors which influence the democratic course of Vietnam.This paper uses historical and constitutional theories to analyze the twiceamendments, raising some points about the relationship between the1992Constitution and innovation.
